Terms of Service

1. Introduction and Acceptance
KynStay is a product of Tilted Labs LLC, a California limited liability company. These Terms of Service ("Terms") govern your access to and use of the KynStay platform.
By creating an account or using KynStay, you agree to be bound by these Terms and our Privacy Policy, which together constitute the complete agreement between you and us regarding the platform.
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use KynStay. By creating an account, you confirm that you meet these requirements.
2. What KynStay Is (and Is Not)
KynStay is a platform that helps property hosts share their homes with invited guests, typically friends and family. We provide:
- Property listing and management tools
- A booking calendar and reservation system
- Guest invitation and communication tools
- Booking coordination and payment tracking
Important: What KynStay does NOT do
- We do not hold, escrow, or take a cut of funds between hosts and guests
- We do not guarantee any payment between hosts and guests
- We do not provide property insurance or liability coverage
- We do not verify or inspect properties
- We are not a party to any rental agreement between hosts and guests
KynStay provides tools for hosts and guests to coordinate bookings and track payments. Where payment is arranged directly between a host and guest—bank transfer, Venmo, cash or similar—the method, timing, amount and any dispute are solely between them, and KynStay only records what they tell us.
Card payments. Where a host has enabled card payments, guests pay the host's own Stripe account directly. The host is the merchant of record: they receive the funds, they pay Stripe's processing fees, and they are responsible for any chargeback. KynStay initiates the charge on the host's account, and initiates a refund on that account when a booking is cancelled (per the host's cancellation policy, or for the amount paid where an unsecured booking is released automatically), when the host or KynStay support issues one, and where a card charge must be returned because it landed on a cancelled or already-settled booking or captured more than was owed. KynStay does not otherwise move money on a host's account. KynStay never receives or holds those funds, takes no commission or fee from them, and does not guarantee them. The refund amount due under a booking's cancellation policy is calculated by KynStay from the policy the host selected.
3. User Accounts
- You must provide accurate and complete information when creating your account and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us immediately at legal@kynstay.com if you suspect unauthorized access to your account.
- Each person may maintain only one account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription and Billing
4.1 Plans and pricing
KynStay offers a Kindred plan subscription with monthly and annual billing options. Pricing is available in USD, GBP, and EUR. Current pricing is displayed on our website and during the subscription process.
4.2 Free booking allowance and when billing starts
You do not pay to create an account or to list a property. Hosting is free for your first two confirmed bookings. That allowance is counted across your whole account, not per property, and it is not reset each month: a booking counts towards it once it is confirmed, and keeps counting after the stay is completed. If a booking is later cancelled it stops counting and your allowance frees up again. We may grant your account a different allowance, in which case the figure shown on your billing settings page applies.
When you confirm a booking beyond your free allowance, your paid subscription starts automatically at that moment, using the plan, billing interval and currency set on your account — monthly billing in US dollars if you have not chosen otherwise. If you have a payment method on file, this happens without a further checkout step and we charge that payment method. Confirming the booking is the act that starts billing, and by confirming it you authorize that charge.
If you have no payment method on file when you reach that point, you cannot confirm that booking: your account is paused and stays paused until you add a payment method. If you have one but the charge fails, section 4.9 applies. Your properties, existing bookings and guest conversations remain available throughout; it is confirming new bookings that stops.
4.3 Payment processing
Subscription payments are processed by Stripe. By subscribing, you authorize Stripe to charge your chosen payment method on a recurring basis. KynStay does not store your credit card details.
4.4 Automatic renewal
Your subscription renews automatically at the end of each billing period (monthly or annual) at the then-current price, unless you cancel before the renewal date. We will send renewal reminder notices as required by applicable law.
4.5 Price changes
We may change subscription prices from time to time. We will give you at least 30 days' advance notice of any price increase. If you do not agree to the new price, you may cancel your subscription before the increase takes effect.
4.6 Cancellation and refunds
You may cancel your subscription at any time through your billing settings. When you cancel, your access continues until the end of your current billing period. We do not provide partial refunds for unused time within a billing period.
4.7 Pausing your subscription
If you are not hosting for a while, you may pause your subscription from your billing settings instead of cancelling. You are not billed while your subscription is paused. Your properties remain published and your existing bookings are unaffected, but you cannot confirm new bookings until you resume. You can resume at any time, which returns you to your existing billing cycle.
4.8 Cooling-off rights (UK and EU users)
If you are in the UK or the EU, you may have a right to cancel within 14 days of subscribing or of each renewal, in accordance with applicable consumer protection law. To exercise this right, contact us at legal@kynstay.com within the 14-day period.
4.9 Failed payments
If a subscription payment fails, we will notify you and your account is paused. While your account is paused you cannot confirm new bookings, and your existing properties and bookings remain visible. Updating your payment method restores your account, either immediately or at the next billing attempt. If the payment is not resolved, your subscription may be cancelled.
4.10 Taxes
Applicable taxes (such as sales tax, VAT, or GST) are calculated and collected automatically via Stripe Tax based on your billing address. The tax amount will be shown before you complete your purchase.
5. Host Obligations
If you list a property on KynStay, you are responsible for:
- Ensuring your property listing is accurate and up to date, including descriptions, photos, pricing, and availability
- Complying with all local laws and regulations applicable to your property, including planning permissions, short-term rental regulations, safety requirements, and tax obligations
- Maintaining appropriate property and liability insurance for your rental activity
- Managing all guest interactions and communications directly, and collecting payment directly where you have not enabled card payments (see section 2)
- Ensuring that property access information (lock codes, WiFi credentials, emergency contacts) you enter on the platform is accurate
Hosts may modify booking details (including pricing and dates) and cancel confirmed bookings. If a host modifies or cancels your booking, you will be notified by email and in-app notification.
Cancellation Policy and Host Standing
KynStay monitors host cancellation patterns to maintain trust on the platform. Cancellations made within 7 days of the guest's check-in date are tracked separately as last-minute cancellations, as these cause the greatest disruption to guests. A single last-minute cancellation within any rolling 90-day period, or 3 or more cancellations by you in that same period, raises a warning on your hosting account and may trigger an administrative review.
Where KynStay identifies a pattern of concern, you will be notified in your account and by email. We will not send you more than one such warning in any 30-day period. Continued or escalating patterns may result in restrictions on your hosting privileges or account suspension.
6. Guest Interactions and Bookings
KynStay's role is limited to providing the platform. All rental arrangements are between the host and the guest directly.
While KynStay provides tools for tracking payment status and displaying host payment preferences, we do not hold or escrow funds and take no commission on them. Payments arranged directly between host and guest are entirely between them. Where a host has enabled card payments, guests pay the host's own Stripe account directly and KynStay initiates the charge, and any refund, on that account—see section 2.
KynStay is not responsible for:
- The condition, safety, legality, or accuracy of any property listing
- The conduct of any host or guest
- Payment disputes between hosts and guests
- Cancellations or no-shows by either party
- Property damage, personal injury, or any losses arising from a stay
7. Deposits, Cancellations and Refunds
This section describes what you pay to hold a booking and what you get back if it is cancelled. The amounts are set by your host's chosen policy; KynStay calculates them and, on a card booking, initiates the resulting refund (see section 2).
7.1 Deposits and holding your dates
A host may require a deposit — a percentage of the booking total — before a booking is confirmed. The default is no deposit, in which case this section does not apply to your stay. Where a deposit is required, once the host accepts your request your dates are held but the booking is not yet confirmed. It becomes confirmed once the deposit has actually reached your host — on a card payment that is immediate, and where you are paying your host directly it is once they confirm they have received it. Your host may also choose to confirm the booking without waiting for the deposit.
You must submit the deposit within 48 hours of the host accepting, or by the start of the check-in day, whichever comes first. Where check-in is within 7 days, or where the host requires the full amount as a deposit, the entire booking total is due up front instead of a deposit-and-balance split. The check-in-day cut-off is measured in the property's local time zone.
If the deadline passes without a deposit, your host may release the dates, and on properties configured to do so the booking is released automatically and your dates become available to others. A payment you have already submitted and that your host has not yet confirmed does not count against you, and your host may extend the deadline. Where a booking is released automatically after a payment has been taken, that payment is refunded in full.
7.2 Cancellation policies
Each property carries one of four cancellation policies, chosen by the host. The policy is shown to you before you confirm a booking, and again on your booking afterwards. The day thresholds below are the standard settings; a host may adjust them for their property, and the settings that apply to your booking are the ones shown to you at the time of booking.
- Flexible — full refund if you cancel at least 1 day before check-in.
- Moderate — full refund if you cancel at least 5 days before check-in.
- Strict — full refund if you cancel at least 14 days before check-in; 50% of the accommodation cost if you cancel at least 7 days before.
- Non-refundable — no refund, whenever you cancel.
The policy that applied when you booked is recorded against your booking and governs it. If your host later changes the policy on that property, the change does not affect bookings already made.
7.3 How a refund is calculated
Where a policy gives less than a full refund, the unrefunded share is treated as an amount you forfeit, and that amount is deducted from what you have paid rather than from the booking total. This matters if you have only paid a deposit so far: because the forfeited amount comes out of your deposit first, you may not receive anything back, and under a non-refundable policy you will not.
The thresholds above are cut-offs, not a sliding scale. If you cancel later than the last threshold your policy offers, you receive nothing back at all — including the cleaning fee. Under Moderate, for example, cancelling four days before check-in returns nothing; under Flexible, cancelling on the check-in day itself returns nothing.
Where a refund does apply, the percentage is taken on the accommodation cost — the booking total excluding the cleaning fee, after any discounts — and the cleaning fee is included in it. Because the forfeited share comes out of what you have paid, a deposit-only guest can still receive less than the cleaning fee alone, or nothing. Timing is measured in days before check-in in the property's local time zone.
If your host cancels a confirmed booking, you are refunded the full amount you have paid, regardless of the policy. A host may also choose to refund you more than the policy requires, but never less. KynStay does not guarantee any refund and is not a party to your booking; where payment was arranged directly with your host rather than by card, any refund is made by them.
Where a refund has been worked out but not yet sent to you, KynStay support may correct the recorded amount, including reducing it, so that it matches what actually happened — for example where money has already reached you outside KynStay, or where the amount recorded as paid was wrong. We record a reason whenever we do. We do not decide how much you should receive as a matter of fairness: that is set by the cancellation policy on your booking, or by whatever you and your host agree between yourselves. This does not apply to a refund that has already been issued to the card, which is fixed at the amount sent to Stripe and cannot be changed by us or by your host.
8. User-Generated Content
You retain ownership of any content you upload to KynStay, including property photos, descriptions, and other materials ("Your Content").
By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and providing the KynStay platform. This license ends when you delete Your Content or close your account, subject to reasonable technical delays and any backup retention periods.
You represent and warrant that:
- You own or have the necessary rights to the content you upload
- Your Content does not infringe any third party's intellectual property, privacy, or other rights
- Your Content does not violate any applicable law
We reserve the right to remove any content that violates these Terms, at our discretion. To report intellectual property infringement, contact legal@kynstay.com.
9. Intellectual Property
The KynStay platform, including its software, design, branding, logos, and all related content, is owned by Tilted Labs LLC and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the platform for its intended purpose. You may not copy, modify, distribute, reverse engineer, decompile, or scrape any part of the platform without our written permission.
10. Prohibited Conduct
You agree not to:
- Use the platform for any fraudulent, illegal, or unauthorized purpose
- Harass, threaten, or abuse other users
- Post false, misleading, or deceptive content
- Attempt to circumvent the platform's security measures or access controls
- Scrape, crawl, or use automated tools to extract data from the platform
- Send spam, unsolicited messages, or bulk invitations
- Impersonate another person or entity
- Use the platform in a way that could damage, disable, or impair its operation
11. Disclaimers and Warranties
KynStay is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we make no warranties, express or implied, regarding the platform, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The platform will be available without interruption or error
- Property listings are accurate, complete, or up to date
- Any particular booking outcome or guest experience will be achieved
Nothing in these Terms affects your statutory rights as a consumer. If you are a UK consumer, you have legal rights under the Consumer Rights Act 2015 relating to digital content that is of satisfactory quality, fit for purpose, and as described. These rights are not affected by anything in these Terms.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
- Our total aggregate liability to you for any claims arising from or relating to these Terms or your use of KynStay is limited to the total subscription fees you paid to us in the 12 months preceding the event giving rise to the claim.
These limitations do not apply to:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by applicable law
Nothing in these Terms limits or excludes any rights you may have as a consumer under applicable mandatory consumer protection law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tilted Labs LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of KynStay; (b) Your Content; (c) your rental arrangements with other users; or (d) your violation of these Terms or applicable law. This indemnification obligation may be limited in jurisdictions where it is not enforceable against consumers.
14. Dispute Resolution
If you have a dispute with us, we ask that you first try to resolve it informally:
- Contact us at legal@kynstay.com describing your concern. We will attempt to resolve it within 30 days.
- If we cannot resolve the dispute informally, either party may pursue mediation before resorting to litigation.
- If mediation is unsuccessful, disputes may be brought before the courts as described in Section 15.
Disputes between hosts and guests (including disputes about stays, payments, property condition, or cancellations) are between those parties. We do not decide them. KynStay does not arbitrate between users and will not rule on who is right or on what either of you deserves.
What we will do is keep the record straight: correcting what a booking says so it matches what actually happened, and unblocking a booking that has become stuck — for example where a refund has been sent but never acknowledged. Correcting a record is not a decision about who is owed what, and the cancellation policy on the booking continues to govern that. We may also provide tools to help you and the other party reach an agreement and record it; using them is optional, and any agreement you reach is between you.
Separately, where a report concerns safety, fraud, or a breach of these Terms, we will review it and may act on it. That is us enforcing our own rules on the platform, not resolving a dispute between you.
15. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
This choice of law does not override mandatory consumer protection rights in your jurisdiction. In particular:
- UK users retain all rights under the Consumer Rights Act 2015 and UK GDPR, and may bring claims in UK courts.
- EU users retain all mandatory protections under EU consumer protection law and EU GDPR, and may bring claims in the courts of their country of residence.
- California users retain all rights under the CCPA/CPRA.
16. Termination
By you: You may close your account from your account settings, except while you have upcoming bookings as a host — cancel or complete those first, so your guests are not left with a stay nobody is hosting. Active subscriptions can be cancelled through your billing settings; access continues until the end of the current billing period.
By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. Where practicable, we will give you advance notice and an opportunity to remedy the issue.
Effect of termination:
- Your access to the platform ceases
- Your property listings are removed
- Your data is handled in accordance with our Privacy Policy
- The following sections survive termination: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and General Provisions
17. Changes to These Terms
We may update these Terms from time to time. When we do, we post the updated Terms on this page and change the "Last updated" date at the top.
Where a change materially affects your rights or obligations, we will state the date it takes effect and will not apply it before that date. Because we do not currently send you an individual notice of changes, please check this page from time to time. If we start notifying people directly, we will say so here.
Your continued use of KynStay after a change takes effect means you accept the updated Terms. If you do not agree with a change, you may stop using KynStay and close your account, as described in section 16.
18. General Provisions
- Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Tilted Labs LLC regarding KynStay.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, power outages, or internet disruptions.
- Notices: We will send notices to the email address associated with your account. You are responsible for keeping your email address current.
